Speaker : Mr. K. Y. Kwok was admitted as a solicitor in Hong Kong in 1987. He is now the senior partner of Li, Kwok & Law, Solicitors & Notaries. His clients include developers, property management companies, banks, insurance companies, Government, public bodies and incorporated owners.

He has been an Honorary Fellow of The Hong Kong Institute of Housing since 2010, and a Convenor of the Panel of Advisors on Building Management Disputes of Home Affairs Department from 2013 to March 2020. He is now a chairman of the Appeal Tribunal Panel (Building) since May 2019.

He has delivered hundreds of law lectures for the Government, public bodies, professional organizations as well as various leading property management companies, including CPD courses to professionals like solicitors, housing managers and surveyors.

Details :

In order to enhance legal knowledge on F&M / Property Management relating to complaint of roof leakage and our role /liability to handle such incidents. HKIS and HKIFM have invited the solicitor Mr. K Y Kwok to share :-

  1. Case Sharing on Facility & Property Management
    1. It is well-known that the water proofing membrane at the rooftop shall belong to the common part of the building, even the rooftop is owned by an individual owner. However, if the rooftop owner conducted the renovation work at the rooftop by themselves and we have evidence that they have damaged the waterproofing membrane. Is the IO or the management company has no liability to rectify any water seepage problem from the rooftop in future.
    2. Please refer to the legal case of “The Incorporated Owners of Summit Court v. Full Surplus Investment Ltd” to support their view that all the water and drainage pipes installed at the external wall shall belongs to the common facilities, even the pipes are exclusive used by individual owner, would Mr. KY Kwok please share his view on this case.
    3. There are so many water seepage cases from the external wall happened in our managed properties, is the IO or management company has the responsibility for assisting the affected owner to carry out the repair works for the damaged areas inside their premises?
  2. Role of Facility / Property Manager or Surveyor
    1. Definite role of Facility & Property Manager or Surveyor to handle any complaint of water leakage to prevent any legal liability due to negligence or misconduct by Facility / Property Manager or Surveyor.
    2. Case Sharing on legal case against Facility / Property Manager or Surveyor by the owners or the clients!

    1. Should Facility / Property Manager or Surveyor be insured/protected by Professional Identity Insurance cover.
    2. If Facility / Property Manager or Surveyor is failed to fulfil his role, any liability should be borne or any penalty?
